Homan Taghdiri believes that all litigation matters are capable of being resolved once all interested parties are: (i) able to give the matter their full attention; (ii) able to completely understand of all the material issues; and (iii) cognizant of the implications of applicable law and the litigation process. Most proficient attorneys almost unanimously agree that in nearly all instances, the litigation process is a time consuming, inefficient, burdensome, and a costly alternative for their clients – which should be avoided to the extent possible. Usually however, the litigation process is the last means available to a party because of the respective parties' misunderstanding (or misapplication) of the law, and/or inability to communicate with each other in order to reach an amicable understanding.
Homan has found that the inefficiencies of the litigation process can be circumvented by the mediation process, and that the mediation process works most efficiently when the parties can fully discuss their claims in strict confidence – and once the parties themselves fully understand the legal process and its implications, there can be a breakthrough allowing the parties to understand the importance and finality of an amicable resolution which does away with the risks and costs associated with litigation. Through his experiences as both a litigator and a transactional attorney involved with complex negotiations and settlements of business and real estate matters, Homan is able to take a truly neutral position, and understand the nuances of not only the entire case, but also, the legal and business issues most important to each party.
